1. Acceptance
These Terms govern your use of the Pomodrama website and your relationship with [AtalayaSoft — full legal entity name] (“we”, “us”), based in Prague, Czech Republic. By using our website or the Pomodrama app, you agree to these Terms. If you don’t agree, please don’t use them.
2. The app and your licence
Your use of the Pomodrama app is licensed, not sold, and is governed by Apple’s standard Licensed Application End User License Agreement (available at apple.com/legal/internet-services/itunes/dev/stdeula/), together with the additional terms below. Where there is a conflict on a point these Terms specifically address (such as the purchase terms in section 4), these Terms apply.
3. Acceptable use
You may use Pomodrama for your personal or professional productivity. You agree not to reverse engineer, redistribute, resell, or attempt to circumvent the paid features of the app, except where the law expressly permits it.
4. Purchases, subscriptions, and Lifetime
Pomodrama is free to download and use, with optional paid plans:
- Monthly and Annual subscriptions, which unlock all Pro features for as long as the subscription is active.
- A one-time Lifetime purchase.
All payments, renewals, and refunds are handled by Apple through the App Store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel them in your Apple ID settings. We never receive or store your payment details.
What “Lifetime” means. Your Lifetime purchase unlocks Pomodrama and every update we release to it, for as long as you use it. If we ever release a major new version (for example, a future “Pomodrama 2” built as a new product), that may be a separate purchase — but the version you bought keeps working, with no features taken away. We’ll always be clear and up front before introducing any such new version.
5. Intellectual property
Pomodrama, its name, design, and content are owned by us or our licensors and are protected by law. These Terms don’t grant you any rights to our trademarks or branding.
6. The app is provided “as is”
We work hard to make Pomodrama reliable, but we provide the app and website “as is” and “as available”, without warranties of any kind to the extent permitted by law. We don’t guarantee that the app will be uninterrupted or error-free, or that iCloud sync (which depends on Apple’s services) will always be available. Nothing in these Terms limits your statutory rights as a consumer under applicable EU and Czech law.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential losses, or for loss of data caused by factors outside our reasonable control (such as iCloud outages). Again, this does not affect any consumer rights you have by law.
8. Changes
We may update the app, these Terms, or our plans over time. For significant changes to these Terms we’ll update the “Last updated” date and note it on this page. Continued use after a change means you accept it.
9. Governing law
These Terms are governed by the laws of the Czech Republic, without affecting any mandatory consumer-protection rights you have in your country of residence within the EU. Disputes will be handled by the competent courts, subject to those consumer rights.
